Employment Agreement on H1B

I am on a H1B visa and in USA. I signed an offer letter given by Company ABC in Jan ’06 stating that I’ll get X amount of dollars before getting a project and Y amount of dollars upon receiving a first project. Also in an offer letter it was written that if I leave the company within 18 months of period, company will cover $ 15,000 for H1B, green card processing, etc… Everything was written in a one page offer letter and it was signed by me and employer. There was no additional employment agreement.

After one and half months that company came up with the revised offer letter stating that I should be ready to except $15,000 less from initially decided salary upon receiving a first project if company can’t place me at a rate what company had initially thought. Also asked me to sign on a new employment agreement with Non compete. This was not mentioned at the time of job offer. I denied signing on a revised offer letter and an employment agreement and they terminated my employment and threatened me for $ 15,000.

My question is:
If they come after me, am I legally responsible for paying $ 15,000 which was written and signed on an offer letter? I didn’t resign willingly but I was terminated as I denied signing a new contract which I was not aware of at the time of job offer.

I would really appreciate your assistance in this matter.

If you already switched your H1 to another company you will be ok. As they terminated you.
If they threaten you then tell them that you will complain to DOL and there is a H1B complaint form on DOLl website which you can fill out and fax to the DOL local office where your ex-company is located.

Fortunately, I have got a new job offer now and they are going to file my H1B transfer under premium processing on Friday (03/10/06). As my employment was terminated on 27th February there will be gap of 10-12 days. Would that be a problem? I am not sure whether my old employer has revoked my H1B petition or not. My old employer has not sent me any termination notice or my H1B revocation notice.

I have a valid Visa and I-94 till year 2008. Does that make any difference in this situation?
