employer withdrawing 485 !!! in deep trouble

my employer is withdrawing my 485 petition, it been more than 180 days ....

do u think INS will accept their application ...

so can use the 485 portability and find another employer ....

what steps can I take now to help me later on
 
First, your employer cannot withdraw I-485. You are the owner of that. They can however withdraw I-140 on whose basis I-485 is filed. What happens then no one really knows as INS has not released final regulations for AC-21.

If you have crossed 180 days you should be fine. Tell them to kiss y a good bye.

Next, Keep proof that you were with your employer for 180 days past I-485 filiing. Like pay stub or a letter.

If RFE for employment comes you will need above + letter from new employer saying new job is similar in duties for which LC was done.
 
Your employer is a moron! They dont have any legal rights to withdraw your 485 application. The only thing they can do is to try to withdraw I-140 and even if they send a letter to INS regarding that...you are ok here since you have already passed 180 days! So get a new job asap and dont even bother notifiying INS regarding new job. When they send RFE regarding employment present a new job letter!!!!!!!!

tell ur employer to do what ever he wants and find out about rules. he can only withdraw ur 140 but snce 180 days hv passes that wo't be any good . there was a case publised on shella murty website where they won the case with CSC INS when employer withdrew the I140 after 180 days.:D :D :D show that site to ur employer and tell them it will save some of there money they gonna pay to lawyers and insted should pay u atleast half. :cool: :cool: :p
