I have my I-140 and Labor Certification approval from Company X, I no longer work with company X because Company Y acquire the division where I was in Company X. Company X agreed to NOT withdrawn the original petition and Company Y agreed to take over on the sponsorship after the 180 days period. I am a H1-B visa holder and I have transfer my H1-B without any problem to company Y. Now that my priority date is current and we are going to file for AOS. My question is: When do I need the Employer Support Letter, while filling the I-485 or after the 180 days and Company Y take over the original process?
What will happen if Company X is not willing to provide immediatly a Employer support letter but is NOT withdrawing the original I-140?
