employer sponsored NIW

Hi, friends:

I am a new comer.

As far as qualification is concerned, does anyone know what is the difference between emploer-sponsored NIW and self-sponsored NIW ? I appreciated any input.

Hi,
there is a big time difference if you are a physician - then either NIW can be filed based on (there are 2 subcategories):
1) employment contract in underserved area

OR

2) based on exceptional ability (no employment contract needed)

supporting documents to be submitted are entirely different. For #1 many even file it without any rec letters and get approved.

I stand corrected.

I have read, though, that the NIW is more difficult for physicians than others (like scientists). I don't know if this is true or not.

I am glad to receive all these replies.

It seems to be a little clearer to me now.

I am doing research.

Even my employer's projects are of substantial national interest and I am playing a pivotal role in the same projects, sponsoring by my employer does give me any advantage. I need to fulfill all requirements as in self-sponsored NIW

Am I correct?

Probably. If your company is sponsoring you, get them to spring for a competent attorney.

If you don't meet all the criteria, the application will be denied. Having your employer sponsor you will lend some credibility to the application but will not overcome the legal requirements of such an application.
