Employer\'s Financial Ability to Sponsor Green Cards

Owing to a slump affecting all hitech software contracting firms, my friend is in a critical state. While he currently has 46 employees and is sponsoring 20 green cards at various stages of processing, he is wondering whether if he files for " bankruptcy protection " not bankruptcy per se, will the green cards processees be protected? He pays his employees and would rather pay them rather than the creditors, who can wait, and also be paid penal interest. How will INS view this at the I-140 and again at the I-485 stage.
Any experiences, comments or suggestions!
