Employer Revoking I-140

I have filed for my I485 on February 11, 2002. My Receipt number is WAC 02-115XXXXX. I filed it as a Manager of the company.

My issue is that my management and me have had a fallout and they might be revoking the I 140. I am still on the payroll of the company but not sure as to how long.

I can easily get another job but the question here is whether I can file a AC21 since I am a manager. My lawyers are not sure about this. They have never had a case where the company has revoked a case before hence the number of precedent options are less.

Anyone out there who can help me in this? Any suggestions?
 
It's been more than 180days since you filed your I485.
You are pretty safe. If you are looking for precedence
look into murthy.com, she's successfully defended a case that's almost similar to yours and has since gotten the approval for her
client.

The I485 petition is not filed by the company but is
filed by the lawyer on ur behalf so the company
has no control over your I140 after 6months have passed

you u r in a lucky state but u still need to find a job
with the same description as b4.


I read of a similar case b4 about a company trying to screw
the employee due to mutual hatred and what happened is

he reported it to the Equl opportunity commision and they forced them to pay him 150k i read it in some indian paper.
 
Thanks a ton guys. I have good relations with my company lawyer and she advised me that this move is afoot. Her predicament is that she represents the company as well me and so does not know what to do?

I guess I will have to be on the lookout for a personal lawyer then. Does any one know whether filing it under the Manager category affect the AC21. My lawyer thinks that AC21 is not applicable for any cases filed under the manager category
 
Assuming that the basis for your I485 is employment based, it shouldn't matter. All that matters is the underlying I140, not the post you hold in the company. If your position or duties have remained the same since you filed your LC, you are fine.
