Employer obligation to pay

Hello freinds,
I am in a rather typical situation.Please advice me.

I have my current H1 from company A. I have been till date on project since they sponsered me.They are not geenrationg paystubs regularly and giving me less money than as agreed.I am still to get about 12-15k from them.

Now i am thinknig of filing H1 transfer through Company B (normal process )which will take 2-3 months.

1) How should i get the remainder of money from Company A.
2) Am i totally depended on thier good will
OR
3)Do i have legal right to get the money from Company A till my H1 tranfer is approved and Company B does not run payroll for me.They say they can pay me as soon asi settle with company A.I trust Company B on that

Please advice urgently
 
you have legal right

Change you job than file case against yuor company A. It is written on the application that the company is required to pay written salary. Laso if you ae to be terminated they are required to pay expenses for your return....Check the regs @ immigration.gov

Thanks for the reply.I will look into the web site you have suggested. I have all timesheets sgined by my client.

I have been working for past 4.5 months and have recevied payment only for 1.5 months.
 
Hi! Ashish-

If your current employer is not aware that you are going to leave them & new (futere) employer have no issues with your past (current) employer then I suggest you to tell your current employer that you are taking some vacations for atleast for 60 to 90 days as you need to settle a domestic problem back at home (India).
I hope they will release your payment till that time & once you get your past payments you can always resign. In the mean time you can start working with new employer provided he apply for ur H1 transfer & have receipt notice.

The above is just a suggestion provided it suites you.

Can you please tell me about my legal rights to claim past money from employer.

Do I have legal right to claim money from OLD company after Joining New Company.If so how should i go about.Do i need lawyer to represent me for this

I would really appreciate your answer about this.
