Employer not Applying for GC: Reason?? and Options??

Hello everyone,

Thank you for this platform where we can exchange views and get the information we need.

For some reason, My employer is not applying for Green Card for any employee. When asked he always gives us a future date. Some of the employees have left and joined another employers.

Now, me and my colleagues are worried as our H1b visa is valid till September 2009 (3 year extention not filed yet) and if there a problem or if the company gets into trouble (audited/inspected), we may also get into trouble.

Q1. What can be the possible causes for my employer not applying for labour (for green-card) and giving us future dates for the application?

Q2. Is there a way we can find out if the company is in good legal standing or is being audited/inspected or if anything is wrong?

Q3. Do you suggest us to change the employer?

Can't read employer's mind?

Q3.. is the best option... change the employer.. this time get upfront commitment for the labor, 140 etc..
 
It is likely that there are many US citizens qualified and desiring your position and therefore your position would not qualifiy for GC. Your employer has determined it to be a waste of time and money to apply in the current economic situation.
 
My employer says that he has lodged my PERM in July 2008. As yet there is no news and neither does he provide any information regarding the status. Is there anything I can do to find out whether the PERM has been lodged at all? What are my options?
 
Q1- many reasons.. but had your employer ever applied for anyone? cost could be an issue
Q3 - why second guessing on the reason for Q1, run to get another job if you can.

The petition is FOR you; only employer or his attorney can get information on HIS petition. It is unlikely that there is any news on it yet.

If you do not trust your employer, why are you still workling there?
 
Yes, there is way to know...

Attorney/employer will get information,

If your employer is not disclosing, just move from that company, remember if he started giving troubles at initial stage, you will still have more problems in future ( there is long way to get GC)... think about it.
