My I140 was recently approved on April 29 and I have opted for Consular Processing at the New Delhi Consulate. My employer had a recent name change (2 months back) - no merger, no acquisition, just brand name change due to some regulations.
I was just told by my lawyer that due to the name change I will have to get an amended I140 (approx time told: 8 months - Vermont) or else take the risk of denial while appearing at the New Delhi consulate without the new I140. I was told:
"Historically a company name change has not resulted in the need for a new I-140 for individuals consular processing in India. But recently, we have seen more and more Consulates requiring an amended I-140 in the cases of company name changes. The Foreign Affairs Manual, which is the book of rules adhered to by Consulates indicates that a new I-140 is required in cases of a company name change."
Can you please advise if New Delhi Consulate requires an amended I-140 if the name of the company changes. Any help or information will be appreciated.
