Some employer just never learn from their mistakes. This desi company is based in Piscataway, New Jersey. I joined this company 5 years ago as an H-1b. I worked almost 5 years with the same employer. I had both bachelors and masters degree from US so getting H-1b was not so much of hassle for me. In 2000 my employer filed my labor and then I140 both were approved in record 6+6 months. Now I am waiting for my I485 decision pending since past 16 months. This employer once audited by department of labor NJ for non payment to its employee. After 2 weeks long audit DOL ordered to pay all withheld wages and published this company's name of The Star Leger. Due to bad economy this company is loosing business badly. ALso Indian President adopted wrong policies and several of it's H-1b talented consultants transferred their h-1 to other companies. President of the company takes vacation twice a year one vacation to US destinations and one vacation to India. However, never paid a single day off or promised vacation time to its employees. Also President is very un-professional and uneducated just happened to be US Citizen. Mere six years ago he was living in a single bed room apartment and within 3-4 years boom time he sucks blood of many h1b holders and build a huge house. I am also the victim of his unjustice behaviour and decide to punish him or atleast teach him a lesson. As I said my Adjustment of Status application is pending since past 16 months and he took advantage of my situation. He asked me to pay him under the table so my paystub can be upto date in case I get an RFE. I had no choice but to give him one full pay check under the table. My salary was $90K and I paid him almost $2000/month for 10 months and lost almost 20,000 cash. Now all of a sudden he decided to move the business and left me with no pay stub. My case is still pending and he is not co-operating with me at all. What should I do for such kind of a person. How can I ask for my money I paid cash. I do have cancelled check but payable to my name? I really need your help. I do have all the proof of his wrong doings and newspaper article about this company's audit.
