I have a few questions on filing a complaint with DOL. I am thinking of filing wh4 against my former employer.
1. What is my status during the period the employer commits the violation (not paying the wages). I would like to know this in the context of green card application at any stage.
2. Is there a time limit. I read that there is a 1 year limit. Is this from the day I left him or from the time when he actually didnt pay. What if the employer was resorting to extortion/threats etc like saying that he has canceled the H1 etc but actually not.
Also, what if I have not submitted any resignation letter and neither did the employer give such letter ?
