Hi,

I am working at a client place through a consultancy which holds my H1. The client now wants to hire me directly, but there is a clause in the agreement I signed with my current employer that I cannot work for the client directly after I resign. Is it legally enforceable?

Don't worry. Its not your problem. If you think its a good offer overall, then go for it. Your current employer cannot do anything. If he wants he will fight with your future employer. Its not your problem. If your employer is Desi consultant then take it easy because he can never fight with your future employer and also he will not have all credentials to go to court. If he dares then most probably he will loose. Also do not worry about your current pay etc. You can get every penny from them. Never tell your employer that your leaving before you get your H1B transfered. Get your H1B transfered first, work for a week in your new job and then mail him about your previous pay etc and keep quiet. Send him all your paystubs and keep all copies of it with you.
