Employer Company Reorganization

I have filed I-485 in May 2001 and am currently on EAD and AP. My employer company is being reorganized and will spin off a new company of which I will be part of. My question is how does this impact I-485 processing.

I dont think it will affect in anyway as long as you are doing the same job..Here's my experience..

I applied for RIR on August 2000 and got it approved December 2000..(ya 4months...my luckiest moment in life)..In Jan 2001, our company got bought over, but still our whole entity didn't change..reporting to the same 100 bosses above me...doing the same work..attorney said don't worry nothing will get affected with this..In Dec 2001, then we merged with another company..and sometime in 2002 our company name changed..then again in later 2002 and then again in early 2003.

But all these years, I am still working in the same group...with the same title (actually I was promoted later)..to the same 100 bosses and our division name has never changed either..

Anyway, that's my knowledge of it..donno if I am right or wrong..but I guess the attorney should be right..

I think I will be working with the same group, in the same position. So, I guess I should be ok. I will talk to my company's attorney as well.

did the promotion change your title and what ws your lawyers opinion on that?
I am in a quandry as i have got a promotion too...;)
 
good question...i dont think its the title change that has anything to do...i believe its the pay they probably look at..correct me if i am wrong..so they used some hypothetical pay and i should have it when i get approved or something..anyway...lawyer says..as long as u do the same work..it should be fine...

talk to ur lawyer but I believe everything should be ok..

Correct me if I am wrong.

But change in salary or title should not matter if you are working in the same company. It might become a issue only if you are changing companies.

In reality it should not be expected that an individual has to work for the same salary and in the same position for so many years after the LC is cleared. That really does not make sense.

On the contrary if you are changing a company with a big difference in salary and position then it might question the intent of the individual towards the company with which he filed the GC. Then it might be a problem.
 
Slightly different scenario, but same answer.

Scenario: Company Y buys a part of Company X.

Question: What happens to the people going from Co. X to Co. Y, who have filed their I-140/I-485?

Answer: Due to "successor-in-interest", one "might" be asked to re-file I-140.
