Employer cheating

I have been working with an Indian run LLC for the past 6 months. I was on a project for the first 3 months but on account of a pregnancy, I could not travel and the client allowed for an extension to work from home for a month and a half, but the project ultimately ended. I was to travel subsequently on another project but on account of ill health, my doctor advised me not to do so and I could not travel again. My employer is refusing to pay me for the period on bench, saying it is not bench and that he is not supposed to pay for maternity benefits.

Also, I have been making sales calls and attending conference calls from home and I have e-mails, etc. to prove all of it.

This company applied for my H1 and I have an approval but because of my experience, I plan to revert to an H4.

Can my employer be held legally? Can anyone recommend a good lawyer in the Manhattan area that I can consult with regarding this matter?

Does anyone know what government agency I can send a complaint to and what would the process be?

Here you go. Attached is the H1B complaint form. Fill this out and fax to the DOL office where your employer do buisness.
 
clearly this seems mean of you making them pay for you not able to work

does your employment say that you will be paid maternity leave?
