Hi,
One of my friend sent his I-140 & I-485 application to VSC and recently got his EAC #'s. Now he got a full time offer and interested to take that offer. His employer won't object any even if he take the full time. I am wondering is there any legal problem with BCIS? Because only 10 days back he got his notice's from VSC. Please let me know, if you guys have any idea. Will appreciate your help!

Well the employer who filled his 140, if he does not notify USCIS and withdraw his 140 for atleast 180 days then your friend can use AC21 and continue working for another employer.
 
Even thought I am sure, please talk to more experienced person.

How is your friend going to work? Is he going to use EAD or H1 Transfer? USCIS will know if he used H1 transfer or EAD that he changed jobs in less than 180 days after filling for 485. However, since filling for 485 has nothing to do with your current work, and it is for a future employment, I beileve that it won't be a problem.

Your friend can/will lose his Gc

if VSC adjudicates his case within 180 days of filing

( If your friend's 140 petitioner does not express interest in hiring your friend.
or
If his 140 petitioner is gone out of business.
)
 
Hi Guys,
Thanks for all your responses. My friend contacted Rajiv. Finally he decided to don't take the fulltime offer, because it may create small problems later, which he don't want to take.
