Employer Attitude - Please help!!!

Guys,

I am sure many of you here are fed up of their Employers and their
baseless internal company policies. I am a H-1B worker like many of you, working in San Diego. My I-140 approval has come through and
now I am getting ready to file I-485 (EB2). However what I have been told from my company that they want to delay filing my I-485.

1] Can they do this legally and stop/delay my I-485 processing?
2] What are my options. Can I take a legal course of action ?
3] Can I go ahead and file it myself. What do I need in that case from the
company ?

Please advice Gentleman. I will really appreciate some direction as I am very tense right now and want to break free of this H-1B thing ASAP.

This seems also to be a good occasion to practice your negotiating skills, you will need those after getting the GC :-)

Your company needs to provide an Employment Letter, after that they do not see any forms.

Financial reasons may partially explain your company attitude. I do not know what your deal is, however you may offer to pay all the expenses and see if this changes their attitude. The bill will be in the lower to medium 4 digits depending on your situation. In my case the lawyer processes just my case and I paid his (pretty big) fee out of my pocket. In the current economic climate it is not good to be too visible :-)

You may also want to sit down with your managers and go through your plans for the medium future. In my view it is better to commit to one year with the company and get them to apply now than to wait under pressure in your current situation. CSC seems to keep up a good pace but who knows what will happen 6 months from now.

One way or the other you will need to be in good term with the company for the forseable future (reference letters and so on). Just put your cards on the table and start an open discussion with them.

Proactive had some good advice and I would agree with it. But more practically, ypou need the original I-140 to file the I-485 along with the employment letter. So you need the employer\'s cooperation for filing I-485 one way or the other.
