Employer Agreement Issue - Pls help!!

Hi All,

I am employed by a big corporation in California. My company is ready to start my Green Card processing. But they have asked me to sign a 3 year agreement which says that if I leave them before 3 years, I will have to pay them all expenses paid by the company for my GC process till that date. Being a big corporation, the company's attorney says that the total cost comes near to 20K USD.
Recently I just saw the new regulation by Department of Labor application, which says that from July 16 employee is no longer required to pay for the expenses related to labor certifications(including the recruitment costs, attorney fees and application fees). My question is, if I sign such a agreement(which says I will have to pay for all GC costs if I leave before 3 yrs), do I really need to pay if I leave before 3 years ? Would it not be against the DOL regulation for the employer to ask for the Labor expenses ?

I need to decide this soon, so pls help if you can. Any inputs whatsoever, will be highly appreciated. Thanks so much for going through my issue.

Regards.

hi, Anyway, if you start the process now, it will take easily 3 years to get GC. Do not delay your GC process, if your company is well established and you have no issues at your job, start the process immediately. Every day, rules and regulations are changing. Before you blink 3 years will go away, but make sure you will not stuck at your company and others will not take advantage of your visa status.
Either way, any such agreement is illegal and can be challenged easily. So don't worry about it, but start the process.

wishes,
