Employer after Merger?

Hi all,

I've worked for company A for 3 years, then switched to Company B. After 2 years, Company B merged with Company C and became Company B-C. I was rehired by B-C (but my H1 wasn't changed, continued to use same visa). For PERM purposes, do you think Company B and B-C are the same? Or are they "different" employers and therefore can I use my 2 years w/ Company B?

Any thoughts are appreciated. Thank you.

You can definitely use Company B experience for a new PERM application filed by Company C. In your green card application, there should not be any mention of the merger.

DanielaDeLaVega thank you very much for your concern. My current company is called B-C (after merger they kept both names of merging companies). So it's actually B-C that's applying for a GC on my behalf (thus the merger is self-evident in company name).

From your response I understand that in that case my experience under company B cannot be used. I guess it's just one of those details that doesn't come up every day. My lawyer isn't entirely sure either, will keep posted. Thank you again.
