Note from Rajiv:
INS has indicated that it will consider an I-485 to have been abandoned if an I-824 requesting Consular Processing is received by them. This is bad news. So far we have been processing consular processing cases hoping that I-485 will continue to be active.
Ok I know this and I want a detailed reply for this one.
My wife and myself both are employed and have applied for two I-140s seperately. One has been approved for AOS and the other awaited to be approved in another 10 days for CP. On both application each one of us are dependents and primary respectively. So my question is what stops from both CP and AOS going in parallel, since INS handles AOS and CP is handled by NVC, except for the fact that INS can track on a case by case basis if the spouse\'s name appears in one I-140 as Primary and other I140 as dependent. The above rule mentioned talks of I-824 being filed. I will not file any such application. So how does one AOS get abondoned. Please let me know if anybody in the same situation has faced any problem.
