Hi Guys,
Is there anybody who was allowed to join the client and was kept on Zero Payroll after applying for 485? My client is screwing me to join them and Emplifi HR director says we dont do it, but if you get any examples we will do it. Please post.

What do you mean by zero payroll after joining the client? Detail please.
 
Meaning..

Letting you take unpaid vacation for the time the 485 is approved. I know it does not make sense after the 180 days rule. But if the application is screwed up by the Legal, then there are high chances of RFE. So, they let you work for the client and still have you on unpaid vacation.
 
I am not sure they would do that.....

I mean keep you in the company without pay and at the same time let your work for someon else. If you have completed your 180 days you will be better off transfering to the client. Emplify will do a smooth transfer including keeping your GC processing as is.

By doing as you say you are just complicating matters. Well that\'s my opinion. I know of atleast 2 cases personally who have had no problems changing jobs from Emplify to client after 180 days.

AshVSC - Question for you.

Can you give details abt. how the two folks who joined their clients from Emplifi regarding if they retained the same lawyer, what if an RFE etc. Your inputs greatly appreciated!

The client manager spoke the Emplify personal manager

that they want to convert the contractor to full time employee. Gave a 15 day notice as required. In case of such conversions client has to pay some fee to Emplify which they did.

I also switched jobs with similar procedure. Passed on details of EAD, AP and 485 receipts to the client Legal dept so they can keep track of expirations for EAD and AP. Also provided them with labor filing copies. Incase of an RFE I was assured by Emplify that the lawyers regarding that and in turn the client legal dept will take care of the paper work. The purpose of providing labor filing copies was so they can keep the job description similar in the employment letter which is important for AC21.

Everything was handled by the hiring manager for the client. All I did was provide them the docs they requested. Speak frankly to your manager and express any concerns you have. Once everything is settle you can call your personal manager at Emplify and speak to him/her and mention about the fact that your GC is in process....

AshVSC - I\'m also in the same boat as you are - 180 days over and .....

My client manager has already spoken to Emplifi(I think accounting manager for my project) about hiring me. I\'m yet to give my resignation letter. I do not have copies of labor filing. How did you manage to get one? Let me know.
Also if there is an RFE will Emplifi\'s lawyer respond or your client\'s lawyer. In my case, the client legal dept. has promised to help me get the required documents etc.. but they said they will not directly involve in the case since they do not know the case details..
