Emp letter required for family based filing?

I don't have it..but have paystubs + returns/w2/1099s for the past 3 yrs. Has any1 got an RFE for emp letter for family based I864 ?

You will definitely get an RFE in you don't send the employment letter.

They have changed the process as to where you dont' have to send but previous year of tax returns and w-2.

You must send the employment letter. It should contain the following:

On company/business letterhead or with company/business stamp

Name of Company/Business
Address
Telephone #

Name of Superivisor
Date of Hire
Job position/title
Salary/wage

Believe it or not, you still may get an RFE even if you send everything in the first time. It can happen.

Page 11 of Instructions:


It says pay stubs for the most recent 3 tax years, 6 months and/or a letter from your employer if you believe any of these items will help you qualify.

It says and/or, if I were you I would take the 'and';)

I know from experience they will request the employment letter because we sent w-2's and tax transcripts for 3 year and we got the RFE for the letter.:o
 
You are required to send in the last tax return.

Optionally you can send last 3 years tax returns, employment letters and paystubs.

You *may* get an RFE if you don't include the optional stuff, so include it to be safe rather than sorry.
