Guys,

Please help me! I am a person who is working for a consulting company, now my company is intending to cancle my H1 visa, for I already have my EAD and over the limitation for 180 days. Do you think it would be a bad influence on my green card if they announce the cancle of the H1? Do they have the authority to revoke my labor, I140, I485 or something? I am really in danger, my current project is done, I still don\'t find another one, I know I could try to get a job, but I still want my company to hold my statues before I have got something.

So, gurus, please tell me whether I could let my company cancle my H1 visa or whether they have the authority to revoke anything?

When did you file the I-485? Is it already over 180 days? if so then your are alright. Just find ano

You should be fine...

If your ND is Aug 10 2001, then I believe your RD should be somewhere in June or July, you have
crossed 180 days with RD/ND and also have EAD. Normally when you apply for EAD, company
would not be interested in renewing your H1 because you already have your EAD.

Now don\'t worry about H1 and look for job and I think very soon you should get GC approval,
mean time if you are out of project then you should go on vacation till you find the job else
there could be difficulty in responding to RFE if at all you get.
 
You need to find a similar job BEFORE your company cancels your H1B status

You will be fine if you find a similar job before your company cancels your H1B status; otherwise you will be in trouble and may have to start over.
 
You\'re fine right now (regardless of whether the company cancels the H-1 or not, BUT . . .

You will need a permanent, full-time, similar position to sponsor the GC. H-1 cancellation is not relevant here. Since morethan 180 days have passed since your I-485 was submitted to INS, you should be fine even if the employer cancels the LC and the I-140 (they can\'t cancel the I-485 since it is not their filing, it\'s yours).

Again, the biggest problem you face right now is to ensure that you have a permanent full time similar position to sponsor your GC.
