Emergency Visa Stamping Appointment in Toronto,Cananda

Hi,

My H1B was approved this year starting oct 1st 2007 and my OPT expires on oct 15th 2007.

My company has assigned me a project in toronto, canada starting from sept 17th till oct 5th 2007.

Can i return to US using my EAD card, offer letter and pay stubs or do in need a H1b stamp.

If i am required to have a H1 B stamp can i take a emergency appointment in toronto?

From October 1 you will no longer be in F-1 (OPT) status. You may be able to return to the U.S. without an H-1B visa, but it depends on an immigration officer whether or not they give you H-1B status.
If they give you F-1 status, your employer has to file another H-1B petition (change of status application) before October 15 all over again if they want you to continue working.

Tell your employer to have their lawyers to take care of your situation. Besides it will be in your employer's best interest to make sure that you will be able to continue working in H-1B status.
 
Please make sure that you get your H-1B stamp. Since your OPT is valid till October 15, therefore on return to U.S. you will get I-94 till that date. This will override the current I-94 from the H-1B approval notice.
