Emergency Help required for applying for 1-485 stage)

I-140 has been approved 1 yr ago, PD is 06/14/1999. Waiting for EB3 to become Current to apply for I-485
Nationality : INDIAN

Problem:
1] Company has terminated as of May 18 2001, Saying they cannot give bench due to lack of contract work.
2] Instructed me to change H1 transfer and shall continue the processing of GC.

Request:
1] Is it the right time to transfer my H1 while trying to apply for I-485.
2] Current Company ( who is processing my Green Card ) are instructing me that they shall do the processing of my papers even after I make a H1 transfer. Is it legally possible for my Old company to process my GreenCard Papers eventhough they have terminated me or when I am with the new company on H1B.
3] Does the request 3 affects me while attending the interview for I-485.

Hi taka-tiki,

      I saw all the other instructions of your. It helped me a lot. Couldn\'t sleep all night, when my friend told me I should be getting my pay stub from the sponsoring company all times till I get my GC. Is this true?

I came to US on 10/10/96, Note I do have only a year and 5 months left. My current company (who terminated) told me they shall process till I get my GC. when filing for I-485 my H1 pay stub from a new company after H1 tranfer, shouldn\'t give any problems right.

You do not have to continue to get pay stubs from your sponsoring company at all times. I would reiterate again that GC is for a future job and as long as your sponsoring company is ready to give you a prospective employment letter, you are ok.

Few things you should be taking care of -

1. Do not be out of status at any point in time.
2. Do not receive any money from an employer without prior authorization.
3. Make sure that your sponsoring company does not revoke your previously approved i-140. They have the right to do that. As long as you maintain good relationship, you should be ok.
