Email After Interview

My wife and I had our interview yesterday and it was very strange. The interviewer didn't ask much questions and didn't speak english very well. After the interview he didn't say anything, just told us to mail in our 1040.
Before sending in our 1040 we have to amend our 2005 because our tax person did our taxes as "single".

Today I got an eamail saying the I130 has been approved. The status on the I485 has not changed.

I'm confused, I'm not sure if the approval had anything to do with the interview yesterday. We couldn't read the Interviewer very well, he just looked confused.

I-130 approval has nothing much to do with I-485. All you need to pay attention to is the I-485 approval - once it's approved your GC will be on the way!

By the way, did the officer tell you if the FBI name check has been done or pending?

Can you tell us waht documents did you submit as proof of relationship and for affidavit of support?

thanks!

When you will submitt the 1040 for 2005? I think you need to submitt that first to in order to get the final approval.

Normally the I-130 gets approved after the interview if everything is okay and then you received the welcome letter, but since the I-130 is really for the petitioner...you must submitt the other paper first so know what's going on with your I-485.

Good luck,

Proof of relationship you would like to go to the AOS Timeline Interview the first page, has good links about it.

For the Affidavit of Support, you need to follow the instructions on the form I-864. (recent tax return of the petitioner or joint sponsor -if it's the case-, employment letter and last paystubs)

Good luck,

I just want to see if 2005 tax returns are absolutely necessary for interviews before March 31st or was it asked for because other documentation was insufficient. Did you take an employment verification letter with you and 2005 w2s?

At the interview, we took our w2's for 2003, 2004 and 2005. We didn't take any 1040's (our fault). He did question why we filed separate, I guess he knew without us providing the 1040's.

We didn't want any "issues" so we figured we should amend our taxes (since he questioned it) and then submit it, he gave us 3 months to submit it.

Yes, it is necessary to carry everything. Even the transcripts of the previous tax returns (I forgot almost that one!), there are some experiences over here, check the AOS Interview Timeline threat. Tax transcripts, the W2's, paystubs, current employment letter...remember they will verify if you still are capable for the financial support, sometimes they don't ask but you must be prepare.

Well, you probably will need to have an answer of why you haven't file yet since anyway there is few days to go (16 days exactly) and probably you have everything to file taxes already. It is not a must, but better come up with an answer.

Good luck,

I had my interview on 27th March, I was asked for 2004 tax return, which i had with me. I asked her mysesf if it ok that i dont have one for 2005. She said she doesn t need it yet because we don t have obligation to file untill 14 of April. That was the end of it, She didn task why my husband filed last tax as single.
