Eligible for AP?

My parents came here on Tourist Visa in early 2001. Duration of stay was approved for six months. During the fourth month I applied for their extension of stay.

In the mean time, I have started their GC Processing (that was during the 10 month of stay, and the extension approval hasnt come yet, but was approved later). We submitted all the forms (around October 2001), except the AP.

All the processing went fine, except for the Birth Certificates. INS wanted DNA tests to prove that My parents are My parents :confused: . We got the Tests done, and have submitted the same to INS. They replied saying that it would take 6 months to make a decision

Are my parents eligible for Advanced Parole?

Any help is appreciated.

Did your parents overstay their visa?? (I94?) or did you file papers before their authorized stay expired??

INS will consider them out of status if their papers were filed after their I94 expired thus making them in-admissible for a period of 3 to 10 years if they leave the us on an advanced parole and try to re-enter.
