eligibility for EA

Hello,
Anyone's opinion will be highly appreciated.

I am now on H1B but I want to start GC. What are my chances of being approved in the EB1 category provided the following:

1. I am PhD in economics, and MS in information management
2. Have one publication in a top journal
3. Have multiple research papers and international presentations.
4. Currently work for a major corporation as econometrician
5. Have multiple minor awards and prizes.

DO I HAVE TO BE A GENIUS TO GET APPROVED????
(Please, note that in the field of Theoretical economics, you need only a few publications in a major journal in order to get tenure: wondering if the approving officer knows that)

My company is willing to sponsor me for EB2, however I want to avoid the lengthy labor certifications.

Do I have any chances in the EB1? Which sub-category is better to apply. Can I check all EB1 subcategories within a single petition, or should I use separate petitions for each.

Many thanks for your help.
Regards,
Magggie:confused:

No, you have to meet 3 of the criteria outlined by the BCIS.

If one publication in your field is considered significant, then every one of your referees must stress this in their letters. The reviewer will defenitely not know this. Even if he does, if you don't tell him you will get an RFE (see previous threads on this subject).

Personally, I think your case is on the weak side. You might want to consult with an attorney to review the particulars of your case.

I recommend apply in the EB12 (Outstanding researcher) category rather than the EB11 (extraordinary ability) where the criteria is generally pretty high.

You need to find a lawyer who has a lot of experience dealing with such cases. If your company lawyer is not experienced in this I recommend finding a lawyer yourself. Some of them may give you a free appraisal on your chances.
