Eligibility for 7th Year Extension

Hi there,

I entered USA on H1B visa on August 9, 1998.

My company applied for an H1B ammendment(related to reduction of pay) on December 12, 2001 and this ammendment resulted in the grant of an H1B with a new expiration date of December 31, 2004, which is about 4.5 months more than the stipulated 6 year term.

* Will I be able to file for a Green Card before December 31, 2003 to be eligible for the 7th year extension?

* Is my H1B valid beyond August 8, 2004?

* How is the 6 year term calculated in this case?

It's upto you and your company to file labor before Dec 31, to qualify.
 
Thanks for your reply. But Since my company and myself are both willing to process the Green Card, I'd like to know if I'm eligible for the 7th year extension.

That's what I meant.

I do not know about the validity of the H1 after 8/04. But if it is valid, then you need to get the your labor application in by the end of this year. So (say ) in Nov 04, you apply for your 7th year extension, you will be elligible
