Effect of non-availability on AC21

I am on H1 right now which expires in Dec 2006. I plan to change my job soon (before December) and work using my EAD (which I have not used yet). However my EAD expires in December 2006 also. I plan to apply for extension of EAD and travel document in the next couple of days. Will the non-availability of visa numbers for Eb2 category have any effect on the approval of EAD and travel document?
Also, will I be able to make use of AC21 for changing jobs, does non-availability of visas affect AC21 in any way? It has been 3 years since my I140 was approved. Please advice
