Effect of Lay Off

Hello,

I am currently on an O-1 visa. Given the current economic situation, there is a very real possibility of a lay off.

1. If I get laid off how long am I permitted to stay in the U.S. I have been in the U.S. for 20 years so just packing up and leaving immediately would be very difficult.

2. I go to school in the evening. If I get laid off, can I transfer to an F-1 (my employer has just submitted an I-140 for an EB-1).?

3. Are there any other options to stay in the U.S.

I would appreciate your advice at this stressful time!
 
you have a grace period of 10 days to apply for another non-immigrant status or leave the country, which is same as other visa status, such as H1B visa.

If you plan to visit someone or sightsee, you may apply for a B-2 within the 10-day period. As long as you filed the adjustment of status, you will be allowed to stay in the U.S. while your case is pending.
