I am currently working for a company under OPT (have plenty of time left on OPT). I am in the process of completing my MS (did not have it finished on the day I started work, but had a US Bachelor's). In the process of submitting my H1-B application, the company's attorney informed me that I would not be able to use my M.S. degree (which will be done in a couple of months) when applying for a green card because I did not have it on the day I started working.
My question is about which date matters for educational qualficiation for green card application (I guess this makes a difference in the request priority)? Is it the status of educational qualifications on the day that I join the job under OPT, or is it my educational qualifications on the day my H1-B status is effective, or is it some other date?
Also if I am stuck with only using my B.S. when applying for a green card in the future, can anyone give some feedback on the extra delay relative to someone applying with a M.S.?
