Education issues

I need some guidance as to consular processing. Is three year degree an issue with the NVC also? My labor just got approved and it states that the requirement for job is Bachelor's degree or foreign equivalent. I have a 3 year degree and 1 year diploma which has been evaluated by two different agencies as equivalent to US degree.

Does anybody has any personal experience .

Once you make it through the I-140 approval this will not be an issue
at NVC or the Consulates.

{ I don't want to dishearten you but some folks in the I-140 thread had faced an RFE for the same issue and lawyer has to provide some kind of justification. You can check in the I-140 thread in this forum, it is divided according to service centers.

And as stated by the previous post once you go thru I-140 afterwards nobody checks that part }

Sorry to say this.

You are likely to get an RFE during your I-140 stage. I was one of the victim who got RFE for the same problem, But, I just got my I-140 approved today after just over 2 years since I applied.

But good thing is that response time was fast in my case. I got an RFE(second, first one was for company's ability to pay) for education issue during first week of April'2004 and we responded immediately and got an approval today (07/08/2004).

I didn't mean to scare you.

1. Did your labor application stated the job requirement as 'Bachelor's degree or foreign equivalent combination of education/experience' or was it just 'Bachelors degree'.

2. What is your field of study and job classification.

3. Do you intend to go for CP? Do you think it will be smooth sailing now with NVC and consulate?

1. No, it was not stated. My ETA 750A, column# 14 had "Bachelor's or equiv."

2. In ETA 750A, major field of study column had "CS, Comp. App., Comp. Eng, Business or Commerce". My educational qualification is B.Com (3yrs) and a Two year diploma.

3. I haven't decided yet. I have no idea about CP. I need to go through CP forum thoroughly.

Please let me know if you find any Pros and Cons of CP.

Actually, I am also struggling to find out the pros and cons of CP. Six months ago, I wouldn't have debated and just opted for CP as it was a fast track. But now, with so many recent changes with respect to concurrent filing of I40/485, backlog reduction pilot programs, lot more rejections and denials without RFEs, it seems to be a very difficult decision. I am still looking and will definitely post if I find anything.

You mentioned in your last reply that you had RFEs on educational qualification. What was the stand you had taken to satisfy that RFE? Was it just the educational evaluations?

My educational evaluation was done long back when I applied my first H1B. I think my attorney used the same evaluation certificate. This certificate says that I have a Bachelor's degree (i.e. US Bachelor's degree). My attorney had sent a clear explanation how 'Bachelor's degree or equivalent' should be read broadly to include a combination of degrees. Also explained the education system in India and how it is different from U.S.

thank you for sharing information. so your degree evaluation for 140 REF is the same one for your H1B long time ago? I used to think that degree evaluation has an expiration date. It seems it is valid for a long time... Could you please clarify me?
