Education Issues while I-485 Pending

First of all I like to see heading “Education Issues while I-485 Pending” under I-485 Issues thread, if its possible for the Administrator. If not then we can continue here.

Today I tried to get admission in part time/evening classes at Virginia Community College to upgrade skills and it requires an admission application, which was asking my status.

My choices were:
- Temporary Alien
- Permanent Alien

If I picked temporary Alien then it was asking visa details. If I picked Permanent Alien then it was asking my A#. So the question is should I give my A# and claim myself as a Permanent Alien or that’s a lie?
I am trying to save some dollars in fees, oh sorry its not some, a lot.

Any advise?

Temporary/Permanent Alien

I would go with permanent as usually the standards are set by college/institution itself for tuition fees related issues. They want to make sure that they are sucking maximum permissible fees from you, permitted by law. Usually temporary aliens pay out-of-state fees and that is higher than in-state (or resident) fees.

Also, people who are waiting for AOS usually do not have a valid VISA (except H1/L1). So they won't be able to provide any VISA details if they opt for Temporary.

One remains a temporary alien until granted permanent residency. This means that 485 waiters are considered temporary. Having an A# number by itself does not make one a permanent alien, even students on OPT have A# numbers.

If you declare your status incorrectly, even if for saving a few dollars, the consequences can be grave and might come back to haunt you in future.

485 waiters can declare their visa status as "adjustee".

Thank you to scare me but appreciate that. I dont see that option in the college option list.

Yes, I am. didnt I say appreciated. chill yar. today is good day I got the job for next 11 months and I dont want to see anyone mad at me, not atleast today.

Don't scare every one out here........:)

As I said before, to decide temporary/permanent alien, standards are set by the college themselves for the issues related to the fees. In our college database, system had only two options (Citizen & F1) to identify the individuals regarding their visa status. They decided to place me in citizen category :D, as the visa I was holding that time was not an option.

I would go and ask the college bursar/registrar and/or international student advisor before coming to any conclusion. They might just be using the above information to make decision regarding tuition fee and/or to get grant from institution/Govt..

485 status

I filled I485 pending (even though I am on H1) and university asked for 485 receipt. And that's abt it. Fees were reduced to half!
