Hi Gurus,
I'm planning to use a labor substitue to file I140. I've a question:

The original labor requires a Masters degree. I've 4 yrs BTech and 1.5 years MTech degree from India. And I've about 7 years of experience. My question is, are my qualifications equivalent to the masters in US?

Can I go ahead and use this labor for filing my I-140.

Any advice is greatly appreciated.

It depends on what the LC says is required. If it says a Masters degree is required, expience is not acceptable and a Masters degree is required. You must have had the qualifications required at the time the LC was filed, your present qualifications are irrelevant.
 
Thanks Jim. LC says it requires MS. My question is, Is 18 months masters degree from India is equivalent to MS in US?

You can use this LC, provided:

a) Your qualifications of B Tech + M Tech can be equated to
a Masters Degree in US while satisfying the field of study.

You need to get your qualifications evaluated with a good
agency.

b) If the LC has any requirement for experience and you have
that experience.

AND

You have acquired both your educational qualifications and
experience before the LC FILING DATE.
