Education evaluation for a 4-year degree.

I have a B.S. degree (4 yrs) from home country, and a M.S. from a US university in the same field. We are about to file EB3 I-140 which required a B.S. and 3 yrs of experience.

I am surprised the paralegal is talking about education evaluation. I browsed this forum. It seems all evaluations stem from a 3 year college system. Anybody has done evaluation on a 4-year degree? Thanks.
 
In your case the request to have an educational evaluation is an added sense of security projected by your paralegal/attorney. Although it is not 'required', it would be an added incentive to have an Educational Evaluation and a copy of your MS sent with the paperwork.

In that way, your case will be rock-solid thereby saving you and the attorney a lot of headache. Thats all.

I have experienced the same situation and my case had no problems whatsoever.

I did mine....

I have the same situation. My company who did my frst H1 did the eaducational evaluation and I have been using that since, even for H1b extensions. It is always good to show that your 4 year degree is equivalent to 4 year degree in the U.S.

I have never been asked for an evaluation until now. This is my 2nd H-1B employer. How much does the evaluation cost? Thanks.

Honestly, I am not sure how much it is going to cost as my employer paid for me at that time.

Hope some body else can answer.

Thanks to both of you for your responses.

I just got the response from the paralegal. According to the attorney, I do not need evaluation since I have B.S. and M.S. (US) in the same field and both were rewarded before the whole LC process. I guess the paralegal just sent standard checklist for everyone at the start of the process.

meg_z, I'm not sure your paralegal was right.

If your job requires BS+3 years, that means you have to get your BS, AND work more than 3 years after BS, and all these need to happen BEFORE you join your current company.

So in your case, if you worked 3+ years after you got your master's degree and before you joined your company, you don't need the evaluation. Otherwise, you can expect one RFE to come for the evaluation.

My EB-2 case requires BS+5 years. I had BS, after that worked 8 years. Then got a US Master's. After that, worked one year before I joined this employer. For my case, an evaluation is required since I didn't work 5 years after my master's degree. My first degree had to used to make myself qualify for the job. Use your own judgement here. Most of the time, paralegals(even attorneys) know less than you.

Here is the evaluation service I used. Cost only $70 and it was fast. Fax your transcripts and ask him to fax back the evaluation report if you are in a hurry.

You have a MS in US...which means the US education system has already validated your 4 year degree. No need for educational evaluation. Tell your paralegal that you have a US degree and that'll shut her up.

I have MS in US and My EB2 140 got approved with no educational eval.
 
Who said a US Master's degree validate your foreign 4-year degree? The attorney who handled my first H1-B case thought the same thing and guess what, we got a RFE after 7 month asking for an evaluation. And I didn't blame USCIS for the RFE since there's a reason for it: I know many people with 3-year BS degree got admission into MS program and graduate with the US master's degree.
