Even if you are NOT doing real academic-like research while working as a software engineer, you should show a letter, signed by your sponsoring institute (remember, EB1-OR is an employer-sponsored category), to the INS detailing your work essence -- that is, to prove you are doing real scientific/academic research.
INS doesn't care what you are doing outside of your official job.
Yes, I got the same issue when I applied for EB1-OR last year. I even got a RFE from INS which asked me to submit a letter to show I have been doing research. I finally managed to have my case approved after half a year waiting.
