Guys,
Could you please help me here:
1) My PD is back in 2004 and labor filed under EB3. I've a MS from a USA university and eligible for EB2. But my prev employer filed under EB3.
2) My I-140 and I-485 are concurrently filed in 2004 and I'm facing retrogression.
3) I changed employers after I-140 approval and 500 days of pending I-485
Here is the scenario:
1) Company A filed under EB3 in 2004
2) I'm currently with Company B since Jul 06 on AC21 under EB3 category with PD 2004
3) Is there a way I can file with Company C / company A under EB2 and use the priority date of EB3 labor and still continue with Company B. I do not want to move from Company B. But can company A / company C help me do this, if I'm ready to pay them few bucks for filing my labor / I-140 under EB2.
Is that really possible so that I get a EB2 PD instead of EB3 PD in 2004. Worth doing this?????
