EB3 Visa numbers exhausted?

I attended Infopass on 6/25 at St.Paul ,MN.
IO told me that no EB3 visas available till october.All the numbers are exhausted.
I asked specifically about name check and security check and she told it's done.
Then I asked if I can expect 2nd FP as my first one might have expired (3/2005).She told me Since recently in May I appeared for EAD FP I will not get 2nd FP and the one taken for EAD was attached to 485.

If Visa numbers are exhausted how come still we see approvals...are these already alloted numbers? Is July Visa bulletin will be republished?

Lots of folks are reporting similar experiences at Infopass. At first I dismissed it thinking that the IO could have been misinformed or purely ignorant. But now I am starting to believe that there might be some truth to it. It's possible that TSC has exhausted its first batch of visa numbers and waiting for a fresh batch to be released. It's also possible that the USCIS run out of all the visa numbers for this year, which seems less likely considering they just made everything current.

The slow rate approvals coming out of TSC kind of validate this claim.

I think all the 2002/2003/2004/Some 2005 I-485 filers of EB3/EB2 who are eligible are approved from TSC and now the wave is going on in NSC. There is no quota; if any one is approvable they are approving. Name check is THE constraint to approve the cases. I know at least 5 cases pending because of NC. Yesterday also one of my friends case with PD Jan2003(EB2)/485-Feb2005 got approved.

DON'T Worry guys...we all get approvals...Mine is on the way after July 2nd...

Mine and my wife's got approved on June 20th. Got approval notice sent email on the same day and a LUD next day. Received approval notice on 06/25 and it says that I have to wait for biometrics notice.

Guys, it is unbelievable to know that my case has been approved and i was going thru shit for last couple of days ...

I talk to IO and they said my case has been approved yesterday but no emails yet to me ...
I asked her million times and she was so nice to check several times for me.

She also said, all the 18,000 cases should approve by July end ...No doubt about it ....You all will get it ....

July may bring Tsunami in TSC

I believe, TSC will get fresh batch of data next month. The July bulletin has specified that the dates will be current. Moreover, July-September will be the last quarter for fiscal year 2007. I read somewhere that USCIS releases quarterly Visa numbers to service centers...

So near but so far..... Heck with all this. Can't concentrate on anything.

I know many cases who are Eb3 India with PD from Mid 2002 ( transfer from VSC to TSC)
name check etc cleared and no sign of life from TSC. All mute.

Sorry to give you this bad news.
 
When retro happened in 12/2004. At that time the applications processeing dates at VSC were until 06/2003. Also at that time NSC had a two years backlog of 485 applications. Now due to the current state..

My Expectation is NSC had more files with priority dates older than 06/2003. and VSC-TSC had more applications after 06/2003. That is the reason we see many approvals with very old priority dates. If any one's application meat the PD and RD criteria...then it is purly bad luck or due to NC checks...

on 01/07/2007, there is a possiblity that we expect significant number of approvals being there is a possiblity that some of the applications crossed the final stage and waiting for July 1st. this is guess.

I see there will be a flood of approvals in 01/07/2007.

i think you have a good point BUT..
imo only those cases have a chance that have had some LUDs in the past month.. so i thin good news is coming for these group of people.. their cases are all set and only tsc is waiting for visa numbers

HOWEVER dont forget that many many cases did not even have a single LUD after FP.

I am eagerly waiting for my second FP. My first FP was in April 05 and again gave a FP for 4 th EAD in Dec 06.

If that is true, my GC that will be approved , probably
in July, will show up the same picture from my EAD5 that I got yesterday. Btw, VSC received my RFE on 18JUN07 and didn`t ask for FP3 yet. MY FP2 was taken on 09MAR06 and is over 15 months. Splendini, friend of mine, got GC approval, last april, with 18 months of FP. Great!

Most of the finger prints received for transfer cases does not have a LUD.. but they are processing as i copke with IO in infopass.

we are tech guys, we know the issues in migrating the data... probably there is an issue in LUD/Migration data for transfered cases.

Hopefully this is true and all pending I-485 should get approvals soon unless they are stuck in Name check etc..

Some Good Signs in the Mail Box for Pending EB-485

We reported from Orlando that the USCIS might try to clear out some pending EB-485 cases to give a room for the storm of EB-485 applications which would flood the floors and shelves of the Service Centers beginning from next Tuesday, July 2, 2007. This office starts witnessing increasing fingerprint notices for pending cases and approval of long-clogged EB-485 cases.
Reminder: Those living in highrise apartments or large apartment complex should put up the names of their family members on the mail box such that the green card mails are not returned to the USCIS. Under the current USCIS policy, the U.S. Postal Services are not permitted to deliver the USCIS enevelope with "Return Requested" red stamp other than the specific individual named on the envelope. This is particularly true with the green card delivery.

Today morning we got e-mails "Approval notice sent" for our AOS.

Mine was a classic case of retrogression. I think we were all set to be approved just before retrogression.

It was frustrating (nothing against them) to see 2002-03 cases being approved. But now as I see it, we did not get approved because our case was in transit all this time. 3 months while others were getting approved. As soon as TSC got our case, they sent approval notices (should have sent them in 2004). Yesterday they received the cases, and approval notice sent today.

So old timers, if your case status is "sent to another office", and not yet "pending", hang in there. Once it is pending, you will get it within a week or so.

I did not do anything pro-actively. Just monitored the case status online. no e-mails, no senators, no FL, no FBI.

PD Sept 2001 (India).
ND 485 March 03, 2004.
VSC -> TSC March 2, 2007.
FP1 Sept 2004.
FP2 Code3 May 18, 2007.
