EB3 to EB2

My Labor certificate was file in June 2004; I have Bachelor Degree and 5 year experience, for labor certificate. My Lawyer told me that my LC was file under EB3
Is there any possibility to change from EB3 to EB2, while file for I-140?

My lawyer by mistake had filed my I-140 from EB3 to EB2 ( My LC was approved in EB3) and my I140 got denied after 8 months of wait time and I had to refile in EB3.

So be careful before making such conversions.

Not Possible, if your LC was applied without EB2 requirements for your position. Your qualifications does not matter. Even if LC requires BS+5 years experience nowadays USCIS issuing a RFE to downgrade to EB3.
