Eb3 to Eb2, even though LC does nott required one

Hi all
I am sorry for this but this retro is just too much to take. I waited 3 years for LC to clear and now this, only GOD knows when the date will be current for EB3

Any way question for you.
When my Labor was filled in Oct 2001, I did not have my MS degree completed, there fore in the LC requirement we put BS in CS. I have my MS degree now, will it be possible to chnage my case to EB2 even though the LC does not require to have a masters. LC also does not required any experience (My lawyer really really screwed me here, but thats a long story I got my LC and I 140 so far)


Any help wil be appreciated very much

You will need to file for a new LC EB2 there is no way to automatically
upgrade to EB3.
My LC was EB2 . Attorney screwed up at i-140 and made me EB3
I was called for interview even while eb2 was current
Did not approve the case, sighting retrogression.
 
if LC doesn't require master degree, that is your job doesn't require it, then there is no ground to change to EB2...

You can apply separate Labor with EB2 requirements in PERM. After LC approval you will have to apply for I-140.

Once both I-140s are in approved status you can use the PD of EB3(2001) to new EB2 filing.
