Eb3 to eb2 conversion with different employer

hi,

lc done. 140 done in eb3. priority date is dec 2005. 4 yrs with current employer. 7 yrs us experience. 11+ years total it experience. My companys lawyer told me it was not feasible to switch from eb3 to eb2. However I recently got a job offer from another company whole told me they can file in eb2 for me since I have BSc + 5 years experience and retain my priority date.

Is at possible ? Please advice.

Switching from EB3 to EB2 with the same employer is very difficult, because the experience and education gained while with the same employer is generally disregarded. In addition, if your current job didn't require EB2-level qualifications, you'll need to switch to a new position in the company to qualify for EB2. Remember, it's not just you who need the Master's or Bachelor's+5 years, the job also must require that.

It's a lot easier when you switch employers, because you'll be able to use the entire body of experience you gained before joining that employer.
