EB3 - Skilled or Other worker?

Hi,

Can someone tell me how I can find out what category my 485 case falls into? In other words, how do I make sure mine is EB3 Skilled worker and not "other worker"? I showed exactly 2 yrs experience.

What's your educational background? What is your occupation?

In general, if you have a professional job but haven't got higher education beyond a bachelor's degree (although it seems to me that most "professional" jobs in the US require more than just a BA/BS), your category is more likely to fall under EB3. If you have don't have college education, but have the minimum of 2 year work experience, then you are also going to be put in the EB3 category. Unskilled or semi-skilled workers will also be put in the same EB3 category. Looks like EB3 is a very broad category..

BTW there are also EB4 and EB5 (I used to think there are only EB1, 2 &3) and so look at info about these categories at the USCIS site, too, just in case!

I'm in software development. I have done Master's but showed only bachelor's plus 2 yrs exp. as lawyer suggested.

Looks like a EB2 category to me! What's your lawyer's reason? Usually there is no difference between EB2 & 3 in terms of waiting time. But I also read in the forum that if you are from India, China, or the Philippines, it could mean a big difference..
 
It will be EB3 Skilled.

I'm from India. Lawyer wanted to put me in EB3 and in order to be in EB3 I couldn't show Master's as it would make it EB2, so I followed the suggestion.
