EB3 Retrogression

Hi Guys,

My Receipt date for I140/I485/EAD/AP (EB3) was NOV 18, 2004. I received my AP, EAD and I140 Approvals in Jan 05 and since then haven't seen any activity. I see a lot of the applicants on this site seem to have received FP notices within the first 6 months of filing for 485. Any thoughts why I am the 'lucky one' in this case?? Is the retrogression playing any part in this. An update from any of u guys will be greatly appreciated alongwith any details anyone can share regarding the EB3 retrogression.. thanks..

The EB-3 is not retrogressed. It's worse then that now. They are NO VISA numbers available for ANYONE until the new fiscal year. Which is October 2005. WHen the new numbers are available it's quite likely the catagory will be retrogressed. WHo knows what the new priority date cut off will be then. It was June 2002 in the June 2005 bulletin. So your case will not be approved until at least October 2005. For those who have not filed the I-485 they can not do so until at least Oct.

FP Notice received!!!

Thanks for your response, coincidently, my FP notice showed up in the mail today...It was a pleasant surprise. On the topic of Priority dates, I guess, i don't understand the priority date concept well. Is it the LC receipt date or the 485 receipt date?? My LC priority date was Dec 01. If this is what is considered then if I understand correctly, I am still in the running for a visa number this fiscal year right?? an explanation will be greatly appreciated from any of you.. thanks.
