EB3 - INDIA - PD - Need Action

EB3 INDIA will never get to 2001 at this rate . I definitely see something fishy .

While people are working on s.1932 , I want to work on this action item . I want to know the reason why it is '99 while everyone in the world is in '01 . So even if s.1932 is passed , the dates will just mve to 2000 for Eb3 india .

Can someone guide me on what should be done ? I want the people in USCIS to be aware that their actions are monitored so that they are fair and honest . We definitely know that there is the backlog but I CANNOT beleive it will go till '99 .

Atleast we must make them release the numbers they are using in their statistics . IF not to us , at least to some senators / congressman , so that we can get informed .

I agree that something needs to be done. I am with you. I am guessing that you are from Atlanta, GA. I am also. I think we should wait and see if s.1932
gets through and if it does we should see what effect that has on EB3 for India. If things improve (BIG IF) then we will not need to push the issue. However if this legislation does not get through or if it does get through and does not have any effect on EB3 India dates then we will have to do something.

I think the idea of waiting around for years is ridiculous. I do not beleive that renewing EADs and APs for years and being happy with that is a good idea. It may be for some who like their jobs or are lucky enough to be able to move around using AC21 portability but what about those that can't. What about those that are getting paid peanuts and being mistreated but cannot change jobs. Not everyone can jump ship to a better job. What about those that may want to pursue another career or higher education. We cannot do any of those things. We have already been waiting for 3-4 years and now we are being told that we might have to wait another 3-4 years. This is unacceptable and outrageous. What about those poor souls that cannot even apply for their 485 and whose well educated wifes have to sit at home and ruin their careers and lives. There comes a point when one has to say that enough is enough. I am really at that point and a lot of people need to be.

Sorry to say but it is a typical Indian mentality to be just happy with whatever crap people throw our way. I have heard so many people state over and over again that if they can renew their EAD and AP for years to come then they will be fine. That may be a good solution for the short term but what about those that won't even be able to file for years. People who have been waiting for years should also not satisfied with this "AP EAD renewal for years" solution. That is my opinion anyway. We Indians are programmed to take whatever little we are given and never question or demand anything. We need to have more self respect and object to wrong things and not be happy with whatever little we are given. We are very resourceful people and we need to realize that just as we came here and made a life for ourselves against many odds, we can do the same ANYWHERE in the world.

first step. all efforts for 8001, if that also fails as of today it is failing

then it will take 15 yrs to get the current dates
 
This is a political issue. Our faxes or please wont make much difference. Only corporate push can make any difference if at all since they are the folks with money. And only money talks here.

But I have faxed to NC and NY (my brother and his famly are from NY).
 
saras76......to tell your frankly i do not have much hope from indian community....in terms of getting together and fighting against retrogression..

you are right, most of the people are happy with whatever they have and if required they will bend more to accomodate their employers/sponsors......

right now lets focus on 8001 ... we can start work on other things by next week...
 
I agree Indians are not doing enough to get things moving in the right direction. But at the same time I would like to know what are all the options we have? Can we file a case against USCIS for retrogression issues? Following are some of the points that are already made by our folks. Can we have RSK for the case? Will he support us in this like many other good things he has done for the Indian / Immigrant community.
*Like no country based category as that is really against Equal oppurtuninty in one sense. You can debate over it.
*Make sure the visa numbers are used completely for all the countries.
*Separate the family quota out of EB.
*Allow people to apply 485 regardless of visa availability as it will not be approved any way without the date being current.

Please add your points and suggest your opinions.
Of course I sent the faxes. What else do we get to do? I am totally against this retrogression.

Nothing fishy in this people, India is a big country with a small equal quota to the rest of the 200 plus countries in the world.
I know US "empowers" people, but guys you all need to stop talking like you have some sort of power over how this country makes its laws. It is up to their legislators to make decisions on what is in their best interest. Like it or lump it thats the truth. They decide based on popular sentiment balanced with capitalist interest. Fortunately for us the latter works for us, otherwise our words/faxes/emails will have little impact as non voting constituents.
It seems you guys are not aware of the benefits of Sec. 8001 benefits. The dates you guys are projecting are a joke, likely outcome will be current or near current dates for EB2 and 3 categories for all countries of the world.
Regarding others feeling they will accept whatever is thrown their way. it is in the Indian Psyche, we differ with other parts of the world, as we have this notion of karma and a belief in the afterlife and that what good we do in this life is reflected in the afterlife. Perhaps we are programmed to believe we will be born as a New York Brahmin in the afterlife if we do a lot of good! Anyway the bottom line is the US supports its optimal self interest. If we are not in that, then we face this. Just look at this current situation, we struggle with this scenario while our compatriot nurses and physiotherapists speed along in a six lane highway! based on the fact that all of us are waiting and waiting they get in probably within in 6 months(exempt labour, 140 in 2 months and Cp within a few months as no backlogs). Imagine entire green card process in less than a year! Marry one if you can.
As someone said it is political, but only if it is regarding discretionary immigrants. As you can see for those they deem as vital to their national interest special provisions are made.
Lets hope and pray that Sec 8001 is passed. It will go a long way in getting us through the gates.

Lets wait and watch what happens with Sec. 8001. What I am trying to say is that we need to be ready to face the worst and not give up if 8001 does not pass. We can support other legislation or discuss other alternatives. What I am not in facor of is just accepting whatever happens.

I know that we cannot change things by ourselves but we can try to do something rather than just resign to our fate. That is my point. Ultimately, legislators will do what they feel will get them more votes and improve their position for next years election. We are just pawns in this dirty game or politics and racism. BUT we should try to do what we can.

For now lets hope that 8001 gets through.

how many PD with / without Pre-approved Labor

All this retro affair is so un-fair
While Some of us started from scratch that is without using "pre-approved labor" and our PDs are in Y2002 .

And then there are some folks who have come way late with pre-approved labor and have PDs for 2001 !!

Now guess what? They stand to get their GC first !!! And we wait.

There are several such people whom I know personally who are all GC holders now and who came to this country just past 2 years! while people like me having come in 1998 are still waiting ....

Initially IsnAmerica.Org was having lobbying plans and even did some effort to have channel established with RickScwartz who did immigration lobbying earlier in getting few fruits like working on with H1 receipt(need not wait for H1 approval) and Switchng after 6 months of 485...
This happened back in 2000, why can not we do same as a organization..

Cmon guys let us get together... only talking does not help..

Reached my Limit of 50 faxes... I faxed about 50 faxes all with different names and from different states, for e.g. from california faxed more, didnot fax from places like Hawaii etc.. People i think we can still make this S1932 a LAW, if we gather all our resources to send faxes and make calls to the estemmed Senators and Congressmen. PLEASE DUE YOUR DUTY IN SENDING AS MANY FAXES AS POSSIBLE.... THANKS

and its not fair to expect that usa politicians will drop everything and listen to our woes becos we are suffering.......come on....why should they??...there are thousands with problems....even their own citizens..

if we cannot fight for ourselves.....i dont think we deserve anything.......it is the same as before independence........90% if british army in india were indians.........afterall we need to eat...and live a life....so we will do anything for it......and also we want it to be totally secure.......and of course we are happy with whatever we are getting......so no worries.....whatever comes we are ok with it..

I might have been a bit harsh in my earlier posting but you would be naive to think that all this anti immigrant legislation and no care for legal immigrants has nothing to do with politics and race. Where did this retorgression come from. It came from the reinstatement of 245i whereby thousands of illegal immigrants could apply for GCs. Those flood of cases has caused the visa numbers to run out. Why was that done, to grow the political base. How does race come into it. A lot of the 245i cases are from South America and with the Hispanic community being the largest minority and projected to grow a lot over the next few years, it makes sense to increase that base. It is clear and simple. Its just a fact, why no accept it.

I am not expecting US politicans to drop everything and cater to our needs, that would be foolish for any of us to expect. We can continue to live in a make believe land where we are scared to admit that blatant discrimination occurs in our life and that all bad things happen without intent or reason. I am not afraid to talk about it, accept it and then do something about it.

As for the Indians joining the British forces I am sure there were a few Indians who questioned those soldiers and they were dismissed by arguments that the "policies of the British are not driven by race or politics, they here for the greater good of mankind and that the British have a lot of things on there mind, hence we should support them because they would never do anything to hurt us." I don't know about you but this argument sounds an awful lot like the one you made about justifiying all that is being done against us by saying that politicians have a lot on their minds, why should they care for us, that they do not think of politics or race when they make up their minds. They don't care for us because they know we can't vote. Plain and simple.

BTW, I am doing everything possible to support legislation and improve our lot in life. I have been active in this forum for years now and make an effort to help anyone that I can with advice or encouragement. I think I am doing my bit. More recently, I have faxed congressmen, called them and have done everything I can to improve our situation.

With that said, I will not shy away from accepting some ugly truths of life.
