My employer filled a file with the labor department in July 2006 and my approval letter was done in December 2006
. Due to the processing time be so long
I decided to file the I-140 later on. In June 2007 I started to collect all documents necessary in order to send it to the immigration dept. For our surprise in the Visa Bulletim for June 2007 was stating that all visas were current
then my lawyer told me to speed up the process and include the petition for adjustment (I-485). In July 2nd of 2007 they posted a new information stating that those visas were not available anymore
. I spent a lot of money with the physical exam (we are 5 in my family) and those exams could not be use in a few months because it has expiration. My lawyer in this case sent the petition for the I-140 and hold it all forms, physical exams and checks for the I-485. My petition for the I-140 was received in July 16, 2007 and we got the receipt letter
. We were surprised again in the end of July 2007 when the immigration dept decided to receive all petition for the I-485
. We sent all forms and checks to them and the package was received on July 30th according to USPS receipt
. Today is 22nd of September and they did not send the letter receipt and my checks (almost 6 thousands dollars) were not cached yet. My question are: 1st - What is my priority date, the date that the USPS delivered my letter to them or the date they will cash my checks? 2nd- My I-485 can be approved first than I-140 or both case will work together or I will receive approval for the I-140 and wait for many years in order to wait a response for the I-485. Someone has any idea what is going on with them and what can I expect for 2008? Thank you for your help.
