I am new to this forum .. This is my current situation.
I have filed my EB3 I-140 on 12'th Jul 2007 using a substituted EB2 pre approved labor with priority date 25-Dec-2004. Because I didn't have enough experience on this priority date.

and I filed my I-485 concorrently for above I-140. Is there any chance to get my I-140 denied? Please hep me.

Thanks

Waht do you mean? You have to show the same number of years of experience as mentioned in the substituted LC. During I-140 processing you will get an RFE on this.

If you did not have required experience/education at this date, you will definitely get an RFE and will also be hard to reply.

Preapproved EB2 Labor - I140 denied

Hi Sreelash,

My case is also the same. EB2 Labor was transferred on my name and 140 was denied. Employer is very scared to refile 140 in EB3 case. Can you please share your experience?Did you get your EB3 140 approved? What are the checklists I can do before the submission?

I really appreciate your response.

Thank you.
