EB3 Education and I-140

Dear Friends,

My company has a approved labor in EB3 (Vermont service center), which I want to substitute. ETA-750A, column 14:
Education: Grade school: blank
High school: blank
College: blank
College degree required: Bachelors Degree
Major field of study: Comp Sc, Math, Engineering or related field

My education back ground is BS in Math (3 year) and PG Diploma in Comp Science (one year) from an University and Master degree in Mathematics. All these degrees were obtained before the priority date as mentioned in the labor. Do you think I-140 will be success in this case. Thanks in advance

As long as you are NOT filing in Nebraska and you submit a proper evaluation of your credentials, you should be OK. In EB3 category all service centers (except NSC) allow for 3 year degrees + some other degree to be used in leiu of a 4 year degree even though the labor does not state categorically that a equivalent education will be allowed. However, my suggestion is to use some other labor that better fits your education, if available. You may have to go through some RFEs, denial, appeals etc as this looks a little difficult. Consult a good attorney if this is the only option you have, else you have to face problems later on.

Also this is absolutely not allowed in EB2 category. You need to have a 4 year degree for EB2. So if you are thinking of filing in EB2 with this labor, forget it.
