RFE Issued: Sep 28, 2000 (for emp. ver. letter, pay-stubs, etc.)
Applied for I-140 redo since company had been sold & acquired.
RD: Oct 29, 2000 (amended I-140)
ND: Nov 14, 2000 (amended I-140)
AD: Dec 21, 2000 (amended I-140)
Approval Notice received on Jan 04, 2001.
I-485 message still says "On Sep 28th, we sent a request...."

VSC received RFE response on 12/13/00
Message still says "On Dec 8th, send RFE..."

Talked to IIO she asked me to wait for 60days.
Thank god anyway, 30days are passed.
So hopefully I can expect clearance by mid. Feb.

Well, Congratulations to YOU, since you did not have to go through the pain of having to do an I-140 redo necessitated by a company name change.
    But that said, I think that both of us are NOT on the right track. A simple RFE for emp. ver. letter, pay-stubs, etc. should be approved in less than 2 weeks. I PERSONALLY know people who got their approval in 10 days, after submitting their responses to the RFEs.
    LIkewise, an I-485 is normally approved within 2 weeks of the I-140 (redo) being approved. But I am still waiting after (almost) 4 weeks.
    But I think I see a problem in both our cases, and that is that the response to the RFE has NOT been acknowledged by the INS. I remember seeing atleast one other case on this board where the response to the RFE was not acknowledged by the INS and it took a long long time for approval.
    In my own case, I had called up the INS a few times over the past couple of months and all the time the IIOs would tell me that they have sent out an RFE and that they have not received a response yet. Every time I explained to the person the whole story as it unfolded at that point in time. When this same thing happened on Dec 28, the IIO said that this being the case, you should get your approval in 2 weeks. Well....
    I did this exercise yesterday also. As expected, the IIO again told me that they are waiting for a response to their RFE. As always, I explained the whole situation again. This time, the IIO told me that she will take a screen print (whatever that is supposed to mean) and pass it on along-with the information that I had provided. But she was EXTREMELY NON-COMMITAL as to what will happen as a result of this, or how long it will take for my (final) approval. She also did not have a suggestion as to what I could do or when I should call back. But it was a different answer, to say the least....
    I think that once a package misses the path it is supposed to take, for whatever reason, then it is possible that it will become an uphill task to complete. From that point onwards, the most IIOs simply keep asking us applicants to wait for some more time, 2 weeks, 4 weeks, 2 - 4 weeks, 60 days, and so on until at some point somebody realizes (or is forced to realize) that something is wrong. The only thing that I think we can do is to realize when our case has taken longer than normal and start following up as best as we can.
    From the other posings, there is also another person called Samyukta on this board who is in a similar situation, if I understand right. I am trying my best to keep track of the progress that her case is making too.....

Did your lawyer send the copy of I-140 approval notice to VSC?? My lawyer did that and I gort my approval within couple of weeks. Incidently, my I-140 amendment was approved on 10/29/2000 and I-1485 approved on 11/21/2000.

I called IIO two weeks back.He said they received RFE on 12/13.
But now it is already 5-6weeks. Voice mail still says Dec. 8th send
an RFE!!!

Today I talked to Atterney and he said just wait. Nothing else we
can do.

EB2,PD 03/98,FP 06/00,RFE1-w2,employment letter to find another excuse that company name changed- we don\'t care if it\'s a successor in interest etc... So
RFE2 for I140 Redo. ND 02/01/01 pretty much waiting.

Of course 100% Indian
