Its finally over! First the details: PD: 9/97 ND: 8/99 FP: 7/00 AD: 4/25/01. EB3/India. No RFE. Talked to IIO once couple of weeks ago.

After 5 years of frustration, heartaches, false starts, screwups by company and lawyers, I can sleep peacefully today. The company refused to process my case in EB2 and delayed returning my EB3 files by 6mos. Tried CP once based on my wife\'s I-140 (INS refused to process simultaneos cases).

I would like to quote couple of lines from my favorite book that summarizes my feelings:

"We\'ve done it, haven\'t we?" he said
In payment for every effort, for every sleepless night, for every silent thrust against despair, this moment was all she wanted. "Yes. We have."
- Ayn Rand, Atlas Shrugged

Good luck and special thanks to Bhanu C, Myladoor (the real one), Shailesh Gala, Murali and countless others who have made extraordinary efforts in keeping us informed, lobbied congress, maintained web sites etc. Myladoor: I think my id on your site is v485.

Deli,

Congratulations!!!
Do you mean that INS refused to process your CA application
(based on your wife\'s I-140) while
you are waiting for I-485 approval?
Both my company and my wife\'s company are willing to sponsor us.
What is the options for us? Either Both filing I-485 or both doing CA?
What is your suggestions based on your experience?

Thanks!

Hope

Yes, my 485 was pending when we applied for the CP. The CP forms require that you provide an A# if you have one. We provided the one we got from my 485.

If the date is current or close to being current, I suggest going thru 485 now. May be last year CP was a better option, I wish I knew/know. Like everything else w/ this process, its all a gamble.

We also tried for AC-140 at Mumbai consulate...they refused to accept our application because we don\'t fall under their jurisdiction.
