EB2 was denied and on appeal stage. Want to apply for EB3

My EB2 was denied and is now on appeal stage. Also I filed another 140 and 485 and it is now on pending stage. I have three years bachelor degree. My lawyer is saying to apply on EB3 while my other's are pending. My question, is it possible to apply on EB3 and what is my chance on getting approve on EB3?
